You can set your browser to not accept cookies, but this may limit your ability to use the Service. This Privacy Policy covers the use of cookies and other technologies by Playdate Planet only and does not cover the use of cookies or other technologies by any advertisers.

But please note: (1) there might be some latency in deleting this information from our servers and back-up storage; and (2) we may retain this information if necessary to comply with our legal obligations, to resolve disputes, or to enforce our agreements. Third-party websites

There may be places on our website where you can click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on an advertisement on our website, then you may be taken to a website that we do not control. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. We recommend that you consult the privacy statements of all third-party websites you visit by clicking on the "privacy" link typically located at the bottom of the webpage you are visiting.

How you can access your information

If you have an online account with us, then you have the ability to review and update your personal information online by logging into your account and clicking on your account settings.

Your choices about collection and use of your information

·      You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our website because such information may be required in order for you to register as a member and/or create play dates.

·      When you register on our website, you will consent to receive email messages from us about our services or your account. You will be given the opportunity to opt out of any newsletters or commercial e-mails unrelated to our services or your account that we may send to you in the future. It may take up to 10 days for us to process an opt-out request. We may send you other types of transactional and relationship email communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt out of receiving them. Please note that changing information in your account, or otherwise opting out of receipt of promotional email communications will only affect future activities or communications from us.

Children's privacy

Our website is designed for the purpose of creating and scheduling play dates, and its use is restricted to individuals age 18 and above. Parents who provide personal information about their children do so at their own risk, and they accept full responsibility for making that personal information public. We do not knowingly collect personal information directly from children under the age of 13. COPA standards apply in all other respects.

Visiting our websites from outside the United States

This Privacy Policy is intended to cover collection of information on our website from residents of the United States. If you are visiting our website from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. By using our services, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this privacy policy.

No rights of third parties

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the website.

Limitation on liability

To the fullest extent permitted by law, in no event will Playdate Planet be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also any loss of use, data, business, or profits, regardless of legal theory, whether or not Playdate Planet has been advised of the possibility of such damages, and even if a remedy fails of its essential purpose; or arising from your use of the Web site or the Service, even if Playdate Planet has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained in this Privacy Policy, Playdate Planet's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Playdate Planet for the Service during the term of membership.

Arbitration agreement.

By using the Website or the Service in any manner, you agree that the exclusive means of resolving any dispute or claim arising out of or relating to this Agreement, the Service, or the Website will be binding arbitration administered by the American Arbitration Association (the “AAA”) in Columbus, Ohio. If this arbitration clause does not apply for any reason, then you must bring an action against Playdate Planet in a small claims court located in Franklin County, Ohio.

You also agree that you may only resolve disputes with Playdate Planet on an individual basis, and that you may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed. Instead, your rights under this Agreement will be determined by a neutral arbitrator, not a judge or a jury. You are entitled to a fair hearing before the arbitrator. The arbitrator can grant any relief that a court can, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons.

Any proceeding to enforce this arbitration agreement, including any proceeding to confirm, modify, or vacate an arbitration award, must be brought in the state or federal courts of Columbus, Ohio. By using the Website of the Service, you agree to venue and personal jurisdiction there.

This arbitration agreement, and any dispute between you and Playdate Planet, will be governed by the laws of the state of Delaware without regard to principles of conflicts of law, provided that this arbitration agreement will be governed by the Federal Arbitration Act.

Changes to this Privacy Policy

We will occasionally update this Privacy Policy. When we post changes to this Privacy Policy, we will revise the "last updated" date at the top of this Privacy Policy. We recommend that you check our website from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.
